SEC charges ex-Fannie, Freddie CEOs with fraud (AP)

WASHINGTON ? Two former CEOs at mortgage giants Fannie Mae and Freddie Mac on Friday became the highest-profile individuals to be charged in connection with the 2008 financial crisis.

In a lawsuit filed in New York, the Securities and Exchange Commission brought civil fraud charges against six former executives at the two firms, including former Fannie CEO Daniel Mudd and former Freddie CEO Richard Syron.

The executives were accused of understating the level of high-risk subprime mortgages that Fannie and Freddie held just before the housing bubble burst.

"Fannie Mae and Freddie Mac executives told the world that their subprime exposure was substantially smaller than it really was," said Robert Khuzami, SEC's enforcement director.

Khuzami noted that huge losses on their subprime loans eventually pushed the two companies to the brink of failure and forced the government to take them over.

The charges brought Friday follow widespread criticism of federal authorities for not holding top executives accountable for the recklessness that triggered the 2008 crisis.

Before the SEC announced the charges, it reached an agreement not to charge Fannie and Freddie. The companies, which the government took over in 2008, also agreed to cooperate with the SEC in the cases against the former executives.

The Justice Department began investigating the two firms three years ago. In August, Freddie said Justice informed the company that its probe had ended.

Many legal experts say they don't expect the six executives to face criminal charges.

"If the U.S. attorney's office was going to be bringing charges, they would have brought it simultaneously with the civil case," said Christopher Morvillo, a former federal prosecutor now in private practice in Manhattan.

Robert Mintz, a white-collar defense lawyer, says he doubts any top Wall Street executives will face criminal charges for actions that hastened the financial crisis, given how much time has passed.

Mudd, 53, and Syron, 68, led the mortgage giants in 2007, when home prices began to collapse. The four other top executives also worked for the companies during that time.

In a statement from his attorney, Mudd said the government reviewed and approved all the company's financial disclosures.

"Every piece of material data about loans held by Fannie Mae was known to the United States government and to the investing public," Mudd said. "The SEC is wrong, and I look forward to a court where fairness and reason ? not politics ? is the standard for justice."

Syron's lawyers said the term "subprime had no uniform definition in the market" at that time.

"There was no shortage of meaningful disclosures, all of which permitted the reader to assess the degree of risk in Freddie Mac's" portfolio, the lawyers said in a statement. "The SEC's theory and approach are fatally flawed."

According to the lawsuit, Fannie and Freddie misrepresented their exposure to subprime loans in reports, speeches and congressional testimony.

Fannie told investors in 2007 that it had roughly $4.8 billion worth of subprime loans on its books, or just 0.2 percent of its portfolio. That same year, Mudd told two congressional panels that Fannie's subprime loans represented didn't exceed 2.5 percent of its business.

The SEC says Fannie actually had about $43 billion worth of products targeted to borrowers with weak credit, or 11 percent of its holdings.

Freddie told investors in late 2006 that it held between $2 billion and $6 billion of subprime mortgages on its books. And Syron, in a 2007 speech, said Freddie had "basically no subprime exposure," according to the suit.

The SEC says its holdings were actually closer to $141 billion, or 10 percent of its portfolio in 2006, and $244 billion, or 14 percent, by 2008.

Syron also authorized especially risky mortgages for borrowers without proof of income or assets as early as 2004, the suit alleges, "despite contrary advice" from Freddie's credit-risk experts. He rejected their advice, "in part due to his desire to improve Freddie Mac's market share."

Fannie and Freddie buy home loans from banks and other lenders, package them into bonds with a guarantee against default and then sell them to investors around the world. The two own or guarantee about half of U.S. mortgages, or nearly 31 million loans.

During the financial crisis, the two firms verged on collapse. The Bush administration seized control of them in September 2008.

So far, the companies have cost taxpayers more than $150 billion ? the largest bailout of the financial crisis. They could cost up to $259 billion, according to their government regulator, the Federal Housing Finance Administration.

Mudd was paid more than $10 million in salary and bonuses in 2007, according to company statements. He was fired from Fannie after the government took over. He's now the chief executive of the New York hedge fund Fortress Investment Group.

Syron made more than $18 million in 2007, according to company statements. His compensation increased $4 million from 2006 because of bonuses he received ? part of them for encouraging risky subprime lending, according to company filings. It's not clear what portion of the bonuses was for his efforts to promote subprime lending.

Syron resigned from Freddie in 2008. He's now an adjunct professor and trustee at Boston College.

The other executives charged were Fannie's Enrico Dallavecchia, 50, a former chief risk officer, and Thomas Lund, 53, a former executive vice president; and Freddie's Patricia Cook, 58, a former executive vice president and chief business officer, and Donald Bisenius, 53, a former senior vice president.

Lund's lawyer, Michael Levy, said in a statement that Lund "did not mislead anyone." Lawyers for the other defendants declined to comment Friday.

Based on the outcomes of similar cases, the lawsuit might not yield much in penalties against the former executives.

In July, Citigroup paid just $75 million to settle similar civil charges with the SEC. Its chief financial officer and head of investor relations were accused of failing to disclose more than $50 billion worth of potential losses from subprime mortgages. The two executives charged paid $100,000 and $80,000 in civil penalties.

Fines against executives charged in SEC civil cases can reach up to $150,000 per violation. SEC Chairman Mary Schapiro has asked Congress to raise the limit to $1 million.

The SEC has brought other cases related to the financial crisis since it began a broad investigation into the actions of Wall Street banks and other financial firms about three years ago.

Goldman Sachs & Co., for example, agreed last year to pay $550 million to settle charges of misleading buyers of a complex mortgage investment. JPMorgan Chase & Co. resolved similar charges in June and paid $153.6 million.

Citigroup Inc. agreed to pay $285 million to settle similar charges, though that settlement was recently struck down by a federal judge in New York City.

Most cases, however, didn't involve charges against prominent top executives.

An exception was Angelo Mozilo, the co-founder and CEO of failed mortgage lender Countrywide Financial Corp. He agreed to a $67.5 million settlement with the SEC in October 2010 to avoid trial on civil fraud and insider trading charges that he profited from doling out risky mortgages while misleading investors about the risks.

McQueary: I told Penn St. officials about abuse (AP)

HARRISBURG, Pa. ? A Penn State assistant football coach testified Friday that he believes he saw former assistant coach Jerry Sandusky molesting a boy and that he fully conveyed what he had seen to two Penn State administrators.

Mike McQueary, speaking for the first time in public about the 2002 encounter in a Penn State locker room, said he believes that Sandusky was attacking the child with his hands around the boy's waist but said he wasn't 100 percent sure it was intercourse.

McQueary took the stand Friday morning in a Pennsylvania courtroom during a preliminary hearing for Tim Curley and Gary Schultz, two university officials who are accused of lying to a grand jury about what McQueary told them. The hearing was expected to last most of the day.

McQueary's story is central to the case against Curley and Schultz. They testified to the grand jury that McQueary never relayed the seriousness of what he saw. The officials, and Penn State coach Joe Paterno, have been criticized for never telling police about the 2002 allegation. Prosecutors say Sandusky continued to abuse boys for six more years.

McQueary said he had stopped by a campus football locker room to drop off a pair of sneakers in the spring of 2002 when he happened upon Sandusky and the boy in a shower.

He said Sandusky was behind the boy he estimated to be 10 or 12 years old, with his hands wrapped around the boy's waist. He said the boy was facing a wall, with his hands on it.

McQueary said he has never described what he saw as anal rape or anal intercourse and couldn't see Sandusky's genitals, but that "it was very clear that it looked like there was intercourse going on."

Under cross examination by an attorney for Curley, McQueary reiterated that he had not seen Sandusky penetrating or fondling the boy but was nearly certain he knew an assault happened in part because the two were standing so close and Sandusky's arms were wrapped around the youth.

He said he peeked into the shower several times and that the last time he looked in, Sandusky and the boy had separated. He said he didn't say anything, but "I know they saw me. They looked directly in my eye, both of them."

McQueary said he reported what he saw to Paterno but never went to police.

He said he did not give Paterno explicit details of what he believed he'd seen, saying he wouldn't have used terms like sodomy or anal intercourse out of respect for the longtime coach.

He said Paterno told him he'd "done the right thing" by reporting what he saw. The head coach appeared shocked and saddened and slumped back in his chair, McQueary said.

Paterno told McQueary he would talk to others about what he'd reported.

Nine or 10 days later, McQueary said he met with Curley and Shultz and told them he'd seen Sandusky and a boy, both naked, in the shower after hearing skin on skin slapping sounds.

"I told them that I saw Jerry in the showers with a young boy and that what I had seen was extremely sexual and over the lines and it was wrong," McQueary said. "I would have described that it was extremely sexual and I thought that some kind of intercourse was going on."

McQueary said he was left with the impression both men took his report seriously. When asked why he didn't go to police, he referenced Shultz's position as a vice president at the university who had overseen the campus police

"I thought I was talking to the head of the police, to be frank with you," he said. "In my mind it was like speaking to a (district attorney). It was someone who police reported to and would know what to do with it."

Under cross-examination, McQueary said he considered what he saw a crime but didn't call police because "it was delicate in nature."

"I tried to use my best judgment," he said. "I was sure the act was over." He said he never tried to find the boy.

Curley and Schultz are charged with lying to a grand jury and failing to properly report what McQueary allegedly told them.

Their lawyers say the men are innocent and contest McQueary's statements.

District Judge William C. Wenner was hearing testimony Friday to help him decide whether state prosecutors have enough evidence against the pair to send their cases to trial.

Sandusky says he is innocent of more than 50 charges stemming from what authorities say were sexual assaults over 12 years on 10 boys in his home, on Penn State property and elsewhere. The scandal has provoked strong criticism that Penn State officials didn't do enough to stop Sandusky, and prompted the departures of Hall of Fame football coach Joe Paterno and the school's longtime president, Graham Spanier.

Curley, 57, Penn State's athletic director, was placed on leave by the university after his arrest. Schultz, 62, returned to retirement after spending about four decades at the school, most recently as senior vice president for business and finance, and treasurer.

Adrian Peterson plans to play vs. Saints

EDEN PRAIRIE, Minn. - Spending three weeks on the sideline watching his Minnesota Vikings appears to be about all Adrian Peterson can take.

Peterson said on Thursday that he plans to play against the New Orleans Saints on Sunday despite being only about 85 percent healed from a sprained left ankle that has caused him to miss three straight games.

He wants to be there for his teammates, who have found a new way to lose seemingly every week to fall to 2-11; for his coaches, who have been receiving plenty of criticism during this massively disappointing season; and for all the fans who are counting on him to help them in their fantasy football leagues.

"It's very important, especially for my fantasy team owners," Peterson joked. "They've been giving me a hard time on Twitter. But just being out ... seeing my guys go out and fall short week after week and just wishing I was out there to help those guys compete."

Peterson suffered the high ankle sprain against the Oakland Raiders on Nov. 20. After making him the highest-paid running back in NFL history in the offseason, the Vikings didn't want to risk their investment by rushing Peterson back in a season in which the playoffs were not an option.

But Peterson never thought about taking the rest of the season off to make sure he's fully recovered.

"I love this game, so no matter if we were 2-11 or whatever, if I'm healthy I'm going to go out and play," Peterson said. "That's been my mindset from the beginning. Three weeks off, I'm going to be a part of it."

His teammates aren't the only ones eager to see him back. Peterson said fantasy owners have pestered him every week with questions on Twitter.

"Should we play you this week? Please!" Peterson said with a chuckle. "Some of the stuff I read on there is crazy."

Quarterback Christian Ponder's hip pointer has improved as well, so coach Leslie Frazier said the Vikings are expecting to have everyone available for the game against the Saints (10-3). Peterson will be evaluated again on Friday, but all signs are pointing to him returning to the field.

"The way he's moving around, some of the things that really concerned him a week ago at this time don't seem to concern him much, nor does it concern us," Frazier said. "So if he has another good day (Friday), we should be in the clear."

Frazier said the fact that Peterson still wants to play even though there is nothing left for the team to play for speaks volumes.

"A superstar like him, he's going to achieve what he wants to achieve," Frazier said. "The fact that he wants to get back and play with this football team speaks very highly of who he is as a person. He wants to finish this season with his teammates."

Peterson said he still feels some soreness when he cuts and plants, but not enough to prevent him from wanting to play.

"I'm like 85 percent," he said. "But I'll be able to take the pain and whatever it is that comes with it."

FACT CHECK: Gingrich off on his budget history (AP)

WASHINGTON ? Newt Gingrich overlooked a couple of years of red ink when he asserted Thursday night that he balanced the budget for four years as House speaker. And in claiming sole credit for the achievement, he glossed over the fact that budgets are not a one-man show: There was a Democratic president in town, too.

In the last debate before the leadoff Iowa Republican presidential caucuses, Gingrich persisted in repeating a claim he has made often in the campaign, sometimes more accurately than others. Here and there, other candidates, too, reprised misstatements or partial truths from the string of debates and from the stump. Mitt Romney once again declared he has spent his life in the private sector, once again ignoring his years as governor and political candidate.

A look at some of the claims in the debate and how they compare with the facts:

GINGRICH: "I balanced the budget for four straight years, paid off $405 billion in debt ? pretty conservative."

THE FACTS: In the 1996 and 1997 budget years, the first two years he shaped as speaker of the House of Representatives, the government actually ran deficits. In 1998 and 1999, the government ran surpluses. Two more years of surpluses followed, but Gingrich was gone from politics by then and had nothing to do with them.

Moreover, the national debt went up during the four years Gingrich was speaker. In January 1995, when he became speaker, the gross national debt was $4.8 trillion. When he left four years later, it was $5.6 trillion, an increase of $800 billion.

To be sure, Gingrich did not single-handedly deepen America's debt, just as he didn't balance any budgets on his own. He was a driving force along with Democratic President Bill Clinton and figures in both houses of Congress in the economic setbacks and advancements of that time.

ROMNEY: "I spent my life, my career, in the private sector."

THE FACTS: Except, that is, for four years as Massachusetts governor, recent years running for president in the 2008 and 2012 elections, a few years running the Olympics, and the time he put into his failed run for a Senate seat in 1994.

In essence, Romney has devoted himself to political endeavors since his successful run for governor in 2002, and has been pursuing the presidency for five years.

The month after his term as governor ended in 2007, he announced his campaign for the Republican presidential nomination. After John McCain defeated him for the nomination, Romney devoted himself to building a political network, helping Republican candidates raise money, and writing a book that set the stage for his second run for president.

Indeed, Romney, who made his fortune as founder of the investment firm Bain Capital, has not held a private-sector job with a regular paycheck in more than a decade.

MICHELE BACHMANN: "We have an IAEA report that just recently came out that said literally Iran is within just months of being able to obtain that (a nuclear) weapon."

RON PAUL: "There is no U.N. report that said that. It's totally wrong, what you just said."

Bachmann: "It's the IAEA report."

THE FACTS: As Paul said, the report of the International Atomic Energy Agency does not state that Iran is within months of having nuclear arms. The U.N. agency report does suggest that Iran conducted secret experiments whose sole purpose is the development of nuclear weapons but did not put a time frame on when Iran might succeed in building a bomb, and it made no final conclusion on Tehran's intent.

Bachmann also erred by arguing that Iran has "stated they will use it (a nuclear weapon) against the United States."

Iran vehemently rejects that it is developing a nuclear bomb, let alone that it plans to drop one on the U.S.

ROMNEY: "I'm firmly in support of people not being discriminated against based upon their sexual orientation. At the same time, I oppose same-sex marriage. That's been my position from the beginning."

THE FACTS: In large measure, Romney has been consistent in those two positions, despite accusations of flip-flopping on gay rights.

He walked a fine line back in his failed 1994 Senate campaign, vowing to fight for equality but stopping short of endorsing gay marriage. That's the same line he walked Thursday night.

He has changed, though, on whether gay marriage should be addressed at the state or federal level. He has favored a constitutional amendment banning gay marriage at least since the beginning of his 2008 presidential bid, when he was the only major Republican candidate to do so. In 1994, he had said the matter should be decided by individual states. That was before the idea of a constitutional ban had gained traction in politics.

BACHMANN: "After the debates that we had last week, PolitiFact came out and said that everything I said was true."

THE FACTS: Not true.

For the second debate in a row, Gingrich complained that Bachmann wasn't getting her facts straight, this time when she went after him for the big money he made from Freddie Mac. In her own defense, Bachmann cited ratings from PolitiFact, a fact-checking organization that ranks statements on a scale from true to false, with the worst offender being "Pants on Fire" false.

PolitiFact rated two Bachmann statements from last week's debate. One, claiming Gingrich believed in an individual health care mandate as Massachusetts governor, was ranked mostly true. The other, that Romney introduced "socialized medicine" in his state, was judged burning-pants false.

Indeed, Bachmann has the worst record of accuracy in the Republican field, as rated by that organization and traced by others. Fully 73 percent of her statements checked by PolitiFact were judged mostly false or worse. Gingrich was wrong the next most often, 59 percent of the time.

Stocks slide lower as euro worries persist

NEW YORK ? Stocks and the euro fell early Wednesday as worries over Europe hang over financial markets. Energy companies fell hard as the price of crude oil plunged 4 percent.

Italy's borrowing rates ratcheted higher and the euro slid below $1.30 for the first time since January, two signs that the debt crisis continues to pressure Europe's governments. The euro has lost more than 3 percent in three days.

Italy had to pay higher borrowing rates in its last bond auction of the year Wednesday. The euro zone's third-largest economy paid 6.47 percent interest to borrow?3.95 billion for five years, up from 6.30 percent just a month ago. That's a sign that investors' confidence in Italy's ability to pay its debts is waning.

The Dow Jones industrial average fell 106 points, or 1 percent to 11,849 in early-morning trading. Caterpillar Inc. fell 3.4 percent, the most of the 30 stocks in the Dow. The Dow is headed for its third down day in a row. It closed at its lowest level in two weeks Tuesday.

The market appears to be in "sell now and ask questions later mode," said John Canally, investment strategist at LPL Financial. The fear that another bank failure will lead to a wider financial crisis like Lehman Brothers did in 2008 overshadows everything else, he said.

In traders' minds, a slight drop in the euro or a small rise in Italian government bond yields is seen as a step toward a banking collapse. "Just the hint of bad news becomes 'Oh my gosh. The world is going to end,' " Canally said.

The Standard & Poor's 500 index fell 12, or 1 percent, to 1,214. The Nasdaq fell 38 points, or 1.5 percent to 2,541.

The yield on the 10-year Treasury note fell to 1.92 percent from 1.96 percent late Tuesday as demand increased for ultrasafe assets. The dollar also rose sharply against other currencies. The euro lost about out penny against the dollar to $1.29.

In Europe, Germany's DAX dropped 1.6 percent; France's main stock index fell 3 percent.

The steep drop in crude prices pulled down Cabot Oil & Gas Corp, Alpha Natural Resources Inc. and Apache Corp. All three were down more than 3 percent in early trading. The price of crude oil sank $4 to $96 in morning trading.

Other commodities prices also fell sharply as investors shed assets seen as being risky. Commodity prices also tend to fall when the dollar rises, since a stronger dollar makes it more expensive for investors using other currencies to buy commodities, which are priced in dollars. Gold and copper lost each 5 percent.

First Solar Inc. plunged 21 percent, the biggest drop in the S&P 500, after the country's largest solar company slashed its earnings estimate for the year. The solar industry has been hit hard by slower economic growth around the world and as government funding for alternative energy projects has dried up.

Avon jumped 8 percent, the largest gain in the S&P 500. The company announced late Tuesday that its CEO, Andrea Jung, will step down. The cosmetics company has been struggling with erratic financial results and is under scrutiny by regulators.

The Dow is now down 2.8 percent for the week, while S&P has lost 3.3 percent. The Nasdaq is down 4 percent.

The markets have already told is that Europe currently has a broken monetary system, according to Kyle Bass, Hayman Capital Management managing partner.

"Alvin and the Chipmunks: Chipwrecked" ? Puns like these would be unforgivable coming from a human. From high-pitched rodents, they prompt calls for an exterminator. The third in the noxiously contemporary series of new Chipmunks films, "Chipwrecked" is full of the cheapest kind of pop culture references. Here is Alvin aping James Bond with a tail that's "shaken, not stirred," a suggestion to follow the Chipmunks on "Critter" and (gulp) a Charlie Sheen-ism of "winning." This latest Chipmunks film, directed by Mike Mitchell ("Shrek Forever After"), is aimed at a slightly younger demographic than the prior movies (it's rated G), and perhaps shallow references like these are enough to delight youngsters. But I doubt it. Do parents really want stale, cringe-worthy expressions like "Awkward!" instilled in another generation? The Chipmunks' father figure, Dave Seville (Jason Lee, looking vaguely hostagelike), takes his diminutive computer-generated friends on a vacation cruise en route to the Grammy-esque International Music Awards, where the Chipmunks and the Chipettes are an eagerly awaited pop sensation. But the antics of Alvin (Justin Long) throw them overboard and they wash up on a deserted island. David Cross and Jenny Slate do their best to help. G. 87 minutes. One and a half stars out of four.

"Carnage" ? In Hollywood terms, this is relatively tame violence-wise. A pet hamster may be in peril, a bunch of tulips get mauled and a cellphone gets abused, but that's pretty much it. There's more carnage in "Puss in Boots." But for sheer domestic savagery, this is the film for you. Based on the 2009 Tony Award-winning play "God of Carnage" by Yasmina Reza and directed by Roman Polanski, the film is a dark comedy that focuses on the collapse of good manners when two liberal, middle-class couples get together to discuss an altercation between their young sons. Starring a first-rate cast of Jodie Foster, Kate Winslet, Christoph Waltz and John C. Reilly, this may be uncomfortable stuff for yuppies to watch: A polite discussion of child-rearing approaches descends into racial slurs, drunken insults, the airing of dirty personal laundry and some barfing. To fans of the play, relax. "The Girl With the Dragon Tattoo" ? To put it bluntly, this movie kicks butt. If anything, his "Dragon Tattoo" is even bleaker than the 2009 Swedish-language hit. Rooney Mara, who had a small role in Fincher's "The Social Network," gives a controlled detonation of a performance as traumatized victim-turned-avenger Lisbeth Salander. Mara's the breakout star of the year, a cold, detached waif in form, a fearsome, merciless zealot in spirit. How strange it is to say that the nice guy here is Daniel Craig ? who, of all the big-screen James Bonds, comes closest to the nasty, tortured soul Ian Fleming created. Mara and disgraced journalist Craig make an indomitable screen pair, he nominally leading their search into decades-old serial killings, she surging ahead, plowing through obstacles with flashes of phenomenal intellect and eruptions of physical fury. Larsson left behind two other novels loaded with more dark doings for the duo. We haven't seen the last of this tattooed girl. For director Brad Bird, though, the fourth "Mission," rock solid as it is, ranks only as his second-best action movie, after the animated smash "The Incredibles." It's the best of the "Mission: Impossible" movies, Bird making a remarkable transition with his first live-action film after three animated ones, among them "Ratatouille." Bird applies the anything-can-happen limitlessness of cartoons and just goes for it, creating thrilling, dizzying, amazing action sequences. This time, Cruise and his team (Jeremy Renner, Paula Patton and Simon Pegg) are blamed for bombing the Kremlin, so they go rogue trying to clear their names and stop a madman (Michael Nyqvist) from starting a nuclear war. Cruise is pretty much doing the same-old, playing the stone-face who's not very interesting when standing still and talking. That work ethic of Cruise, though, shows in every one of the spectacular action moments. If you have the slightest fear of heights, grip the armrests tightly during Cruise's climb up the world's tallest building; even safe in your seat, an unnerving feeling of vertigo is bound to result as you stare down from the 130th floor. But what seemed clever and novel the first time around now feels stale and tired; a lot of that has to do with the bleak, gray color scheme, which smothers everything in a dreary, suffocating sameness and saps the film of any real tension or thrills. "Game of Shadows" finds Downey's Holmes facing off against brilliant supervillain Professor Moriarty (Jared Harris), who's cooked up a scheme to pit European nations against each other in hopes of benefiting from the demand for arms. Holmes must stop him with the help of his trusty sidekick, Dr. Watson (Law), who's newly married and not nearly so gung-ho about such wild adventures anymore. And it shows in the script as well as the performances; Law gets little to do beyond functioning as the skeptical straight man, and the chemistry just isn't there this time. Noomi Rapace tags along for some reason as a gypsy fortuneteller looking for her missing brother, but the formidable presence she displayed in the original Swedish "Girl With the Dragon Tattoo" and its sequels goes to waste. NYC ban on after-school worship services stands (AP)

WASHINGTON ? The Supreme Court has rejected an evangelical church's plea to overturn New York City's ban on after-hours religious worship services at public schools.

The justices on Monday left in place a federal appeals court ruling that upheld the city's policy.

The Bronx Household of Faith is an evangelical Christian church that has held Sunday services at P.S. 15 in the Bronx since 2002. The church services have been allowed to continue pending the outcome of the school's lawsuit against the city.

The church says the city allows many groups to use school buildings after hours. But the city says that it risks blurring church-state separation if it allows worship services in public schools.

The city says that roughly five dozen congregations used public schools for their religious services in 2009.

Slovenian center-left party headed to victory (AP)

LJUBLJANA, Slovenia ? A center-left party led by a prominent businessman and mayor of the Slovenian capital was taking a surprise victory in the country's parliamentary elections, early results showed on Sunday, reflecting mounting concern over the economy.

Positive Slovenia, led by Ljubljana mayor and former head of the country's largest retailer, Zoran Jankovic, is leading with 29.4 percent of the vote, the country's electoral commission said after counting some 40 percent of the ballots.

The conservatives ? who were favorites to win ? are trailing with 25.8 percent, the officials said. The leader of the Slovene Democratic Party, former prime minister Janez Jansa, conceded defeat and congratulated Jankovic.

The winner of Slovenia's first snap election since becoming independent from the former Yugoslavia in 1991 will have to tackle the country's mounting debt, unemployment and a looming recession.

"The results show that Slovenia will go in the right direction," Jankovic said of the news. "It is obvious that the citizens want an efficient state."

Serbia-born Jankovic won prominence in Slovenia first as the head of the country's biggest retailer, Merkator, running the company successfully for eight years, before he was removed from the post in 2005 by Jansa. He has been the mayor of Ljubljana since 2006.

The vote was called after the center-left government of Premier Borut Pahor was toppled over economic troubles and allegations of corruption.

Pahor's Socialdemocrats were third with 10.4 percent of the vote, the partial results showed. A newcomer, former minister Gregor Virant is fourth, with 8.1 percent, followed by several smaller groups, who won between 4.5 and 7 percent.

Slovenia has been hit hard by the European debt crisis, with public debt swollen to 44 percent of GDP and unemployment at about 12 percent.

Saudi Arabian Women Feared to Have Premarital Sex If Allowed to Drive (ContributorNetwork)

COMMENTARY | Women in the U.S. have a lot to be thankful for despite our poor economy and nearly broken health care system. At least we don't live in Saudi Arabia. Although it seemed the nation was making strides with the King announcing women would be given the right to vote in September, according to the Huffington Post, a well-known academic scholar has now claimed that allowing Saudi Arabian women to drive could encourage premarital sex.

The report given by Kamal Subhi was given to the all-male Shura Council, which advises the monarchy. Subhi claims that allowing women to drive will hurt the country's centuries-old tradition of virgin brides. They believe it will ultimately lead to more commingling of males and females, and promote sex.

Most nations have criticized Saudi Arabia's male-only driving rules, but going up against the ultraconservative culture in the kingdom is going to be a very tough battle for those who hope to see a change for the better in the rights of Saudi women.

When King Abdullah made his announcement to give women the right to vote, he stated, "Because we refuse to marginalize women in society in all roles that comply with Sharia Law, we have decided, after deliberation with our senior ulama (clerics) and others ... to involve women in the Shura Council as members, starting from the next term."

While I applaud his efforts, there is a long way to go before women are even close to being equals in Abdullah's kingdom.

Just days after the King's proclamation, a Saudi Arabian woman was sentenced to ten lashes for driving her car, according to The Guardian. Saudi rights groups claim it was payback for allowing women to vote in 2015.

Married Saudi women must obtain the permission from their husbands to leave the country, seek medical treatment, work, or even to get an education. If you thought the health care system in the U.S. was bad, can you imagine, as a grown woman, having to ask your husband to allow you to go to the doctor? What if your spouse was abusive?

According to A Safe World for Women, in Saudi Arabia domestic violence has been on the increase, and their backward laws do nothing to stop their horrific statistics. It's likely that many cases are not reported at all. Many Saudi women are stuck in isolation, too fearful to report abuse when they are considered such low-class citizens.

Giving women the right to vote, unfortunately, is barely making a dent in the lives of Saudi women when Saudi men are so fearful of giving them independence in other areas of their lives.

Man pleads guilty to killing 4 in NYC rampage (AP)

NEW YORK ? A man accused of stabbing his stepfather and two others to death, fatally running down a pedestrian, carjacking and other violence in a 28-hour rampage across the city this year unexpectedly pleaded guilty Wednesday.

Maksim Gelman pleaded guilty to murder and other charges in the February spree that stretched from Brooklyn to Manhattan. Gelman had previously said he wasn't guilty. He had been under medical supervision, and his attorney, Edward Friedman, described his mental state as "fragile."

But, given the evidence in the case and a psychiatrist's recent opinion that Gelman couldn't argue he was not guilty by reason of insanity, he decided he wanted to get out of his holding cell ? and start serving his time in a permanent facility, his lawyer said. No plea deal was offered.

The 24-year-old Ukraine-born man answered "yes" when asked if he understood what it meant to change his plea. Wearing a baggy orange jumpsuit, his hands cuffed behind his back and his hair closely cropped, Gelman brusquely answered the judge, saying "yes," "yep" and "yea," as the 13-count indictment was read aloud.

The courtroom was nearly empty ? only the boyfriend of one of the victims attended, crying silently in the second row. Earlier court hearings had been packed.

Gelman faces nearly 100 years in prison. A sentencing hearing was set for Jan. 11.

"It's quite likely, almost guaranteed, that any sentence I give means you'd never be released from a penal institution while you are alive," Judge Vincent DelGiudice said during what would have been a routine pretrial hearing at state Supreme Court in Brooklyn.

Gelman said he understood. "Have a good one," he said to his lawyer after he was led away.

Gelman's deadly spree on Feb. 11 started with a family argument over whether he could use his mother's car, authorities said.

After stabbing to death his stepfather in the family's Brooklyn apartment, Gelman left in the car and drove to the home of an acquaintance, Yelena Bulchenko, prosecutors said. Bulchenko's friends have said he was obsessed with the 20-year-old woman and imagined a romantic relationship with her.

Gelman first killed Bulchenko's 56-year-old mother, then waited hours for the daughter to return and stabbed her 11 times, authorities said. He then left the Bulchenkos' home, rear-ended a car and stabbed its driver, they said. The driver survived.

Stealing the wounded man's car, Gelman drove off and plowed into a pedestrian, who died from his injuries, police said. After abandoning the car, Gelman later hailed a livery cab and attacked its driver, then approached another car, attacked a man inside and seized the car, police said. Both men survived.

All those attacks happened in Brooklyn. Gelman was next spotted hours later on a subway in Manhattan, where passengers recognized him from newspaper photographs and notified police, authorities said. He dashed across the tracks, switched trains and attacked a final passenger before he was grabbed by police who were in the subway car looking for him on the tracks, authorities said. The Manhattan case is still pending.

Police later recovered a bloody knife, three straight razor blades, a paring knife and $932.

According to court documents filed by prosecutors, Gelman told a police officer, "I'll beat this. I'll go to a mental hospital for a few years, and I'll get out on the street again, you'll see."

When asked by police why the four victims had to die, Gelman said, "Because I said so," according to the documents. On Wednesday, his attorney asked for time to do another psychiatric evaluation to prove Gelman needed treatment while imprisoned. The Brooklyn district attorney's office said it would seek the maximum penalty available.

Outside court, Bulchenko's boyfriend, Gerard Honig, said he was just happy that Gelman admitted guilt.

"I just want him to get as much time as he can, that's it," he said.

Fox to launch "Ice Age" live show (Reuters)

LOS ANGELES (TheWrap.com) ? Fox is warming up its "Ice Age" franchise for a live show designed by Cirque du Soleil talent, the studio announced Thursday.

"Ice Age Live! A Mammoth Adventure" will be launched by Twentieth Century Fox Consumer Products and Stage Entertainment Touring Productions at London's Wembley Arena in November 2012.

After that, it will go on a five-year, 30-country tour, starting in Europe and eventually hitting the U.S. at a yet-undetermined date.

"It's part of an overall strategy to evolve from the pop-culture experience that the movie is into a pop-culture immersion," Jeffrey Godsick, president of Fox Consumer Products, told TheWrap.

"We're trying to deepen the audience connection" with the franchise, Robert Marick, executive vice president of Fox Consumer Products, told TheWrap.

The production will feature ice-skating, aerial stunts and puppetry. The cast will include costumed versions of "Ice Age's" core characters -- Manny, Sid, Diego, Ellie, Peaches, Crash, Eddie and Buck -- but the show will have a storyline all its own.

While most of the specifics of the show are being kept under wraps, Marick promised "giant animals flying through the arena." Some characters, like Manny, could be as tall as 40 feet, with multiple humans working the costume.

The show will be directed by Guy Caron, who previously worked on Cirque du Soleil productions. Other Cirque veterans are also involved: Michael Curry is handling costume design, and Martin Lord Ferguson co-creating music and lyrics with Ella Louise Allaire.

Ticket prices have not yet been established. A large-scale marketing campaign is in the works.

The franchise's fourth film installment, the 3D-animated "Ice Age: Continental Drift," is due in theaters July 13. Original voice stars Ray Romano, Queen Latifah, Dennis Leary, John Leguizamo, Seann William Scott and Josh Peck will return. New cast members include Jeremy Renner, Jennifer Lopez and Wanda Sykes.

The first three "Ice Age" films drew a combined $2 billion at the global box office, making it one of the top-grossing animated film franchises ever. And the property has amassed more than $4 billion once home-entertainment and consumer-products sales are factored in.

Mexico activist in Juarez women killings wounded (AP)

CIUDAD JUAREZ, Mexico ? An activist representing relatives of women slain or missing in the border city of Ciudad Juarez was shot Friday in what authorities called an apparent robbery attempt.

Chihuahua state prosecutors said Norma Andrade, 51, was shot twice outside her home and was in stable condition in a hospital.

Andrade was the second activist to be shot this week in northern Mexico. Anti-crime activist Nepomuceno Moreno was killed Monday in Hermosillo. He had protested the kidnapping of his teenage son.

Andrade founded an organization of relatives of women who have gone missing or been murdered in Ciudad Juarez to pressure authorities to solve the cases. Her daughter Lilia Alejandra Garcia Andrade was tortured, raped and killed in 2001 when she was 17.

Arturo Sandoval, spokesman for the state Attorney General's Office, said Andrade told investigators that a man approached her outside her house and tugged at her purse. When she tried to hold on to it, the man fired his gun wounding her right hand and left shoulder, Sandoval said.

Authorities were still trying to determine whether it was a robbery or a murder attempt, Sandoval said.

Andrade's daughter, Malu Andrade, told The Associated Press that teachers at the middle school where her mother works said suspicious men had been asking about her whereabouts Friday morning. The attack happened in the afternoon.

"Authorities knew that we had been threatened," the daughter said by telephone.

A series of eerily similar killings of more than 100 mainly young women began in Ciudad Juarez in 1993, but appeared to had tapered off by late 2004 or early 2005.

The killings have been the topic of books, documentaries and the 2006 movie "Bordertown" starring Jennifer Lopez. Lopez in 2007 received a special recognition from Andrade and her organization, Bring Our Daughters Home.

Britain pulls embassy staff out of Iran (Reuters)

TEHRAN (Reuters) ? Britain has evacuated all its diplomatic staff from Iran, Western diplomatic sources told Reuters on Wednesday, a day after protesters stormed and ransacked its embassy and residential compound.

Both properties were severely damaged, with official and personal possessions seized or destroyed, said sources who had spoken to staff at the embassy. One described the damage as "carnage."

Britain said it was outraged by the attacks and warned of "serious consequences."

"In light of yesterday's events, and to ensure their ongoing safety, some staff are leaving Tehran," Britain's foreign office (ministry) said in a statement.

While the official statement referred only to "some staff," two diplomatic sources said that all British staff were leaving.

The two embassy compounds were stormed mid-afternoon on Tuesday during a demonstration in the street outside the main building in downtown Tehran, smashing windows, torching a car and burning the British flag in protest against new sanctions imposed by London.

Protesters broke into the residential compound at Qolhak in north Tehran, a sprawling, wooded property which used to be the embassy's summer quarters.

Iranian media said there were between 100 and 300 protesters in Qolhak and some 50 in the main, downtown compound. The storming lasted for a matter of hours and appeared to be over by mid-evening after local police intervened.

An Iranian report said six British embassy staff had been briefly held by the protesters and then freed by police, something British Foreign Secretary William Hague played down, saying the situation had been "confusing" and he would not have called them "hostages."

Several sources told Reuters that diplomats had had their movements restricted by protesters and one said staff in the main compound had been herded into a room while protesters ransacked the compound.

Iran's Foreign Ministry said it regretted the attacks and was committed to ensuring the safety of diplomats, and parliament speaker Ali Larijani criticized the U.N. Security Council for condemning the attacks.

"The hasty move in the Security Council in condemning the students' actions was done to cover up previous crimes of America and Britain while the police did all they could to keep the peace," Larijani told parliament in an address broadcast live on state radio.

"This devious action will lead to instability in global security," he said.

Kar Va Kargar daily quoted what it said was a statement issued by the students involved.

"The seizure of the British embassy was done by the revolutionary students and this action was not done on the order of any organization," the statement said. "Each free Iranian ... should know that the seizure of this old embassy is in the interest of Iran."

Most Iranian newspapers splashed photographs of the embassy break-in across their front pages.

"Fox's den seized," ran the headline in conservative daily Vatan-e Emrouz, referring to Britain's nickname "the old fox" which reflects a view widely held in Iran that the former imperial power still wields behind the scenes influence in Iranian affairs.

Several newspapers referred to the storming as akin to a repeat of the 1979 takeover of the U.S. embassy in which 52 Americans hostages were held for 444 days, ending diplomatic ties with Washington that have never been restored.

"Seizure of second spy den by Ruhollah's revolutionary children," ran the main headline in hardliner Ya Lesarat, referring to Ayatollah Ruhollah Khomeini, the late leader of the 1979 Islamic Revolution.

It?s a national dish that women have cooked for centuries, but Palestinian chef Agustin Shomali says cooks can easily ruin maftoul.

?They go to extremes,? Mr. Shomali says. ?They think ?the more spices, the better.? ?

Shomali was one of five judges at the fourth annual Palestinian maftoul competition, held on a chilly Saturday in early November just outside Ramallah. About 200 people came to see and taste dishes made with the oversized, soft couscous hand-rolled with water and whole wheat flour.

Traditional Palestinian maftoul dishes feature chickpeas, chicken and broth, cumin, a dusting of cardamom ? and not too much else. But the 12 women vying for the $540 prize marshaled ideas from near and far. They added cauliflower, almonds, and even a snowman made of a hard-boiled egg atop an orange. Ultimately, sticking to tradition paid off for Naima Rayed, a mother of seven from a refugee camp outside Ramallah. She cooked a classic maftoul with plenty of chickpeas, pumpkin, and tomato. In addition to the prize money, Ms. Rayed will travel to an upcoming couscous festival in Italy.

Raed Saadeh organized the evening through the Rozana Association for rural tourism. He said the competition united women of scattered villages.

Norway closes embassy in Iran after Brits attacked

OSLO, Norway (AP) ? Norway has closed its embassy in Tehran due to security concerns after Britain's mission was stormed by Iranian protesters, an official said Wednesday.

Hilde Steinfeld, a Foreign Ministry spokeswoman in Oslo, said the decision to close the embassy was taken late Tuesday, but that Norway's diplomatic staff have not been evacuated from the country. "They're still in Tehran," she said.

Steinfeld would not go into greater detail, but said "the decision follows security concerns." She added that "it is in context with the attack on the British embassy yesterday."

Norway has four to five diplomatic staff deployed in the Iranian capital, she said.

On Tuesday, protesters stormed the British embassy in what apparently began as a state-approved show of anger over the latest Western sanctions to punish Iran for defiance over its nuclear program.

The protesters took down the Union Jack, set fire to an embassy vehicle and pelted buildings with petrol bombs.

Northeast to post warmest November in 10 years (Reuters)

NEW YORK (Reuters) ? The Northeastern United States, the world's largest heating oil market, is set to post its warmest November in a decade, and the mildest for some cities like Boston in over 30 years, forecasters said this week.

The Northeast and East North Central regions, including Chicago, Cleveland and St. Louis, had their warmest November since 2001, Pennsylvania-based forecaster Planalytics said.

Boston was the warmest since 1975, while Indianapolis was the warmest in over 50 years.

Overall, forecasters expect this November to be the fifth-warmest since records began in 1950.

The mild weather was a result of "autumn being autumn" and not a sign of a weakening La Nina weather pattern - expected to continue through winter - or a harbinger of what's to come this winter, according to New York-based Weather 2000 meteorologist Michael Schlacter.

While November's mild weather aided U.S. retailers as shoppers took to the streets, it pressured demand for natural gas to fire furnaces and power plants.

Cash gas prices slid to their lowest levels in more than two years, while gas futures on the New York Mercantile Exchange slid to 11-month lows.

Heating oil prices, meanwhile, were weaker, but concerns about supply disruptions due to recent refinery closures limited the downside, market sources said.

The Southwest coast was the coolest since 2004, with Los Angeles the coolest since 2000, the forecaster said.

Weather 2000's Schlacter noted that while New York City had a "warm" November, it was not "off the charts" or historic in nature.

"Even just this past decade we've had some tremendous swings in weather in November temperatures. We're not that much warmer than 2009 or 2006. We are going to top those, but we're still in the same ballpark as the last five years," Schlacter said.

Overall this November will fall behind November 2001, and will likely be the fifth-warmest on recent record, Schlacter said. MDA EarthSat meteorologist Rick Groh agreed.

All the forecasters noted that cooler weather in the U.S. West would likely skew the overall national average.

"The tremendous cool in the West will likely dilute the impressiveness of the warmth for the nation as a whole," Schlacter said.

NOVEMBER VERSUS THE WINTER

Forecasters were quick to note that November weather patterns were not necessarily indicative of how the entire winter will turn out.

Forecaster WSI has called for the mildest winter in five years, lowering heating demand expectations.

U.S. government forecasters said a strengthening La Nina would grip the country for a second straight winter, causing colder and wetter weather in the most northern states and drier, warmer conditions throughout the drought-ravaged South.

The National Oceanic and Atmospheric Administration (NOAA) said it expects the La Nina weather phenomenon that results in cooler ocean temperatures in the Equatorial Pacific, to become the most dominant factor influencing weather across the country, but added that a change in pressure called the Arctic Oscillation could make it difficult for forecasters to predict more than a week or two in advance.

The volatile condition could produce dramatic short-term swings in temperatures. Arctic Oscillation can generate strong shifts in the climate patterns that could overwhelm or amplify La Nina's typical impacts, NOAA said.

Weather 2000 was calling for a below-normal period from December through March for the nation as a whole, with the Ohio Valley and Great Lakes area the focal points of the coolest weather.

"Last year was very impressive. It's probably not going to be as cold as last year, but could be similar to the 2008-2009 winter for the nation as a whole. The winters the last four years have been in that slightly cool direction and that's where we're leaning this year," Schlacter said.

"Chicago, which had a very, very warm November, just like New York, is already starting this new transition. It's a very slow progress and the Interstate-95 corridor on the East Coast is going to have to wait about six or seven days into December until we catch up with that," he said.

"Everything between the Rockies and the Appalachians are doing a 180 flip starting today or yesterday, compared to what was going on in November, which just shows how quickly things can change," Schlacter added.

MDA EarthSat said the December through February winter period would be normal to slightly above-normal for the Northeast and near to slightly-below normal for the Midwest, above-normal in Texas and below-normal on the West Coast and in the Rockies.

UK space radar project initiated

The UK government is to kick-start an innovative project to fly radar satellites around the Earth, with an initial investment of ?21m.

Radar spacecraft can see the planet's surface in all weathers, day and night.

It is hoped that a series of satellites could eventually be launched, enabling any place on Earth to be imaged inside 24 hours - a powerful capability.

The radar money is part of a ?200m boost for science announced by the Chancellor in his Autumn Statement.

George Osborne's investment will be matched by industry.

Radar is one of the most useful tools in Earth observation because of its ability to track objects and events on the ground even when there is thick cloud.

The project being backed by government has been developed by Surrey Satellite Technology Limited (SSTL), which specialises in building small, low-cost spacecraft, and its parent company, Astrium, which makes some of the biggest satellites in orbit today.

Engineers at the two firms have produced a compact radar platform they believe could win many overseas orders, and are keen to demonstrate its capabilities in space.

The new S-band radar satellite is called NovaSar-S ("Sar" stands for synthetic aperture radar). It is a 3m-by-1m spacecraft with a plank-like appearance, weighing just shy of 400kg.

Engineers have found a way to make it considerably smaller than most radar platforms in operation today, and with a price tag that would also be a fraction of that charged for bigger radar satellites.

SSTL says it can build, launch and insure a NovaSar-S for a customer for about ?45m.

Mr Osborne's investment, together with SSTL's and Astrium's own money, will enable the first NovaSar-S to be put in orbit. It will be ready for launch in two to three years' time.

Assuming this pathfinder meets its design performance and begins to earn money from the sale of its imagery, SSTL plans to launch further spacecraft, to create a constellation in the sky.

Prof Sir Martin Sweeting is the executive chairman of SSTL. He told BBC News: "We're hoping we can use this commitment from the UK government to go out to our international customers, who we know have had an interest in radar for a long time, and get them to participate in the first mission, to start with, but then to take up one or two of the other satellites so that we can build a constellation in orbit."

A NovaSar-S will produce what are termed medium-resolution images, meaning details on the ground larger than 6m across would be discernable.

Economic growth

NovaSar-S would have a number of viewing modes that could enable it to perform a wide range of roles, from flood monitoring and land cover management to disaster mapping and maritime enforcement - notably ship tracking and oil spill detection.

An application where a constellation of NovaSars could find a particularly useful role is in monitoring forests - or to be more precise, in monitoring deforestation. The cloud cover associated with rainforests makes radar a game-changer, allowing repeat viewing of an area whatever the weather.

Ministers have been very impressed with the results of the R and D work and believe a small investment from taxpayers could help leverage big returns for "UK plc".

It is a model with good precedent. A decade ago, the government put ?5m into helping SSTL develop its technology for optical satellites - seed funding that subsequently helped the Guildford-based company win international orders in excess of ?200m.

"Radar technology is quite challenging, and so having government investment to get a demonstration mission up and running is amazingly good news," said Sir Martin.

"It's also a good signal to British industry of the government's commitment to space as an important sector that can provide both national security in the broadest sense but also drive the economy forwards with export earnings."

British space firms have been identified by ministers as an important area for growth in the economy. This view is buttressed by the fact that the sector managed to increase its turnover, year on year, right through the recent recession.
